Video surveillance a powerful tool – with the right considerations

But while it is often essential to have these kinds of systems in place, it is important to make sure that every legal consideration is taken prior to implementation.

“An increasingly important component in the overall security mix, video can be profitable but poses a number of liability-related issues,” wrote Security InfoWatch contributor Eric Pritchard. “Most of them can be dealt with in an effective, enforceable contract and understanding and abiding by some key rules respecting potential sources of liability[.]”

One of the most important factors to consider is the legality of video surveillance in specific states. Pritchard said that Delaware and Georgia prohibit hidden camera systems from being installed. Georgia also forbids the recording of people in “private places.” Alabama has similar restrictions on the books. Much of this has to do, however, with preventing voyeuristic crimes from occurring. It should still be possible to implement a wireless video security system so long as cameras are visibly placed and not hidden from plain view.
